These Terms & Conditions govern bookings and travel services supplied or arranged by Alpenglow Tours & Travels, Gangtok, Sikkim.

By making a confirmed booking with Alpenglow Tours & Travels, the customer agrees to these Terms together with the applicable itinerary, booking confirmation, invoice, inclusions, exclusions, Booking Policy, Cancellation & Refund Policy and Privacy Policy.

1. Booking Contract

The contractual documents applicable to a booking consist of:

  • final written itinerary;
  • booking confirmation;
  • invoice;
  • inclusions and exclusions;
  • Booking Policy;
  • Cancellation & Refund Policy;
  • these Terms & Conditions; and
  • Privacy Policy.

Where a particular booking confirmation contains a specifically agreed condition, that specific written condition will prevail over a general website provision to the extent legally permissible.

2. Services

Alpenglow Tours & Travels may arrange travel components through independent service providers including:

  • hotels;
  • homestays;
  • transport operators;
  • guides;
  • activity operators;
  • restaurants;
  • airlines;
  • railway services; and
  • other tourism suppliers.

Alpenglow Tours & Travels remains responsible for its own contractual and statutory obligations as a travel agency and tour operator.

3. Inclusions and Exclusions

Only services specifically stated under the Inclusions section of the confirmed package are included.

Anything not specifically included should be treated as excluded unless separately confirmed in writing.

4. Accuracy of Information

Alpenglow Tours & Travels takes reasonable care to provide accurate information concerning:

  • itinerary;
  • duration;
  • hotels;
  • transportation;
  • meals;
  • inclusions;
  • exclusions;
  • permit requirements; and
  • package pricing.

Photographs used on the website or promotional material may be illustrative unless expressly identified as the exact room, vehicle or service included.

5. Obvious Errors

An obvious typographical, technical or clerical error may be corrected before final booking confirmation.

After confirmation, the agreed package price will not normally be increased except because of:

  • a customer-requested modification; or
  • a new or revised statutory tax, government levy or official charge becoming legally applicable.

6. Protected and Restricted Areas

Access to protected and restricted areas is governed by competent authorities.

Alpenglow Tours & Travels cannot override decisions of:

  • Government of India;
  • Government of Sikkim;
  • Sikkim Tourism;
  • Army;
  • Police;
  • Forest Department;
  • District Administration; or
  • other competent authority.

An itinerary mentioning a protected destination remains conditional upon legal access and permit approval.

7. Government Rules

The permit procedure, government restriction, security rule and statutory requirement in force on the actual date of travel will apply.

Government rules may change after a booking has been confirmed.

Alpenglow Tours & Travels may modify arrangements where reasonably required to comply with such rules.

8. Itinerary Changes

The order, route or timing of sightseeing may be changed where reasonably necessary because of:

  • permit availability;
  • weather;
  • traffic;
  • road conditions;
  • hotel logistics;
  • operating hours;
  • safety requirements; or
  • government restrictions.

A reasonable change in sightseeing sequence does not by itself constitute cancellation of the package.

9. Traveller Responsibility

Travellers must:

  • provide accurate information;
  • carry required identification;
  • comply with permit conditions;
  • follow government and security instructions;
  • follow reasonable directions of guides and drivers;
  • report at agreed departure times;
  • respect applicable laws and local customs; and
  • avoid behaviour that creates a safety or operational risk.

10. Traveller Conduct

Alpenglow Tours & Travels may discontinue a particular service or a traveller’s participation where the traveller:

  • creates a serious safety risk;
  • engages in illegal activity;
  • threatens or abuses staff or other travellers;
  • intentionally damages property; or
  • materially prevents lawful operation of the tour.

Any such action will be taken reasonably and proportionately.

Costs arising directly from the traveller’s misconduct remain the traveller’s responsibility.

11. High-Altitude Travel

Certain Sikkim itineraries involve:

  • high altitude;
  • cold temperatures;
  • remote locations;
  • winding mountain roads;
  • long road journeys; and
  • limited medical facilities.

Travellers are responsible for determining whether they are fit to undertake the selected journey.

Travellers with relevant health concerns should seek appropriate medical advice before travelling.

Alpenglow Tours & Travels does not provide medical advice.

12. Medical and Mobility Requirements

Travellers should inform Alpenglow before booking if a medical condition, mobility requirement or other circumstance may materially affect the safe or practical operation of the itinerary.

Such information will be processed in accordance with the Privacy Policy.

13. Minor Travellers

A minor must travel with a parent, legal guardian or appropriately authorised responsible adult as required by applicable law and permit/hotel rules.

Required age and identity documentation must be supplied.

14. Special Requests

Special requests including:

  • dietary preferences;
  • bed preferences;
  • particular room location;
  • celebration arrangements;
  • accessibility requests; or
  • similar arrangements

are subject to availability unless expressly confirmed in writing.

15. Adventure Activities

Adventure and optional activities may be subject to:

  • age restrictions;
  • weight restrictions;
  • health conditions;
  • weather restrictions;
  • government approval;
  • safety requirements; and
  • independent operator conditions.

The authorised operator may refuse operation or participation where required for safety.

Cancellation of an optional activity does not automatically cancel the remaining tour.

16. Travel Insurance

Travellers are strongly advised to obtain appropriate travel insurance.

Depending on the journey, insurance may reasonably cover:

  • medical emergencies;
  • emergency evacuation;
  • trip cancellation;
  • trip interruption;
  • baggage;
  • personal belongings; and
  • adventure activities.

Travel insurance is included only where expressly stated in the confirmed package.

17. Baggage and Personal Property

Travellers remain responsible for their:

  • passport;
  • identification;
  • mobile phone;
  • camera;
  • cash;
  • jewellery;
  • medication;
  • baggage; and
  • other personal property.

Alpenglow Tours & Travels will provide reasonable assistance where possible but cannot guarantee recovery of lost property.

18. Environmental Responsibility

Travellers must comply with applicable environmental and waste-management rules in Sikkim, particularly in protected and ecologically sensitive areas.

Travellers must not litter or deliberately damage natural, cultural or public property.

19. Emergency Assistance

Where reasonably possible, Alpenglow Tours & Travels will assist with coordination of:

  • medical attention;
  • evacuation;
  • alternative accommodation;
  • transportation;
  • Police assistance; or
  • other emergency support.

Unless expressly included in the package or legally payable by Alpenglow Tours & Travels, third-party emergency costs remain payable by the traveller or applicable insurer.

20. Force Majeure

Neither Alpenglow Tours & Travels nor the traveller will be treated as breaching the booking contract merely because performance becomes impossible due to an event genuinely beyond reasonable control.

This provision does not provide Alpenglow Tours & Travels with an automatic right to retain money relating to services that were not supplied and whose costs are recoverable.

The financial treatment of such bookings will be governed by the Cancellation & Refund Policy.

21. Limitation of Responsibility

Alpenglow Tours & Travels will exercise reasonable care in arranging and providing the services it has contracted to provide.

Alpenglow Tours & Travels will not be responsible for loss caused solely by:

  • incorrect information supplied by a traveller;
  • a traveller’s illegal act;
  • a traveller’s deliberate or negligent conduct;
  • lawful government restriction;
  • security restriction;
  • circumstances genuinely outside reasonable control; or
  • another cause which Alpenglow could not reasonably prevent.

Nothing in these Terms excludes liability or consumer rights that cannot lawfully be excluded under applicable Indian law.

22. Complaints During Travel

Any material service problem should be reported to Alpenglow Tours & Travels as soon as reasonably possible.

This allows us an opportunity to investigate and, where possible, correct the issue during travel.

Failure to report a problem immediately does not remove any statutory consumer right.

23. Grievance Redressal

Customer grievances may be submitted through:

Email: travel@alpenglowsikkim.com
Phone / WhatsApp: +91 99076 83957

Where applicable under consumer e-commerce requirements, complaints will be acknowledged within 48 hours, and Alpenglow Tours & Travels will seek to resolve eligible grievances within one month.

24. Governing Law

These Terms are governed by the laws of India and the applicable laws and regulations of the State of Sikkim.

Nothing contained in these Terms prevents a consumer from approaching a Consumer Commission, court, regulator or other authority having jurisdiction under applicable law.

25. Statutory Rights

Nothing contained in these Terms will remove or limit a statutory consumer right that cannot legally be excluded.

26. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

27. Policy Changes

Alpenglow Tours & Travels may update these Terms when required because of:

  • changes in law;
  • tourism regulations;
  • government rules;
  • permit procedures;
  • regulatory requirements; or
  • legitimate operational changes.

A revised policy will not retrospectively impose a materially less favourable commercial cancellation condition on an existing confirmed booking unless required by law or government order.

28. Intellectual Property

Unless otherwise stated, original website content, itineraries, branding, graphics and written materials belonging to Alpenglow Tours & Travels may not be commercially copied or reproduced without permission.

Third-party trademarks and content remain the property of their respective owners.

29. Customer Photographs and Testimonials

Acceptance of a booking does not automatically provide consent for Alpenglow Tours & Travels to use an identifiable traveller’s photograph, video or testimonial for advertising.

Separate permission will be obtained where required.
